JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 385, 387 of the Indian Penal Code.

Petitioner is not named in the first information report and it appears that in course of investigation, he was arrested and made his confessional statement accepting his involvement in the present crime.

Submission on behalf of the petitioner is that prior to institution of the present case, Dalsingsarai P.S. Case No. 151 of 2015 was lodged against the petitioner at the behest of informant

Patna High Court Cr.Misc. No.30833 of 2016 (2) dt.09-08-2016 2/2 of the present case and when petitioner got bail in the aforesaid case, he has been implicated in this case by the police in collusion with the informant of the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur in connection with Dalsingsarai P.S.
