Learned APP for the State submitted that since the process of Section 82 of the Cr.P.C. has been issued against the petitioner which is mentioned in para-39 of the supplementary case diary, so the anticipatory bail petition of the petitioner is not maintainable in this case.

In that view of the matter, after making some submissions, learned counsel for the petitioner sought permission to withdraw this bail application. Permission is accorded.

The application is dismissed as withdrawn.

The petitioner is directed to surrender before the learned Court below within a period of four weeks and prays for
