Mr. Prem Kumar Jha, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 13-05-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Gaurichak P.S. Case No. 430 of 2025, instituted under Sections 316(2), 318(4), 324(4), 351(2) and 3(5) of the B.N.S.

3. As per the prosecution case, an agreement was made between the informant and petitioner for purchase of land. After measurement and pillaring the land informant gave Rs. 76,50,000/- to the petitioner as an earnest money and registration of 4100 sqft land was done for Rs. 34,000,00/-. Registration of remaining land is not being done and his Rs. 42,50,000/- is due. Petitioner along with other accused persons started demanding money and threatened to kill him. The

4. Learned counsel for the petitioner submits that the dispute between the parties has been resolved through the process of mediation vide Mediation Proceeding No. 536 of 2026 dated 04.05.2026.

5. Learned A.P.P. for the State and learned counsel for O.P. No. 2 conceded the said fact that compromise has taken place between the parties. They have no objection if anticipatory bail is granted to the petitioner.

6. Considering the facts and circumstances of the case, submission of learned counsel for the parties and compromise has taken place between the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II, Patna City in connection with Gaurichak P.S. Case No. 430 of 2025, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
