The petitioner seeks regular bail in connection with Runisaidpur P.S. Case No. 338 of 2020 instituted for the offences under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.01.2021, charge-sheet has been submitted in the case and has got criminal antecedent as mentioned in paragraph '3'.

Learned counsel for the petitioner submits that allegation is of recovery of 94 litres of Indian made foreign liqour and 35 litres spirit from the hut of Kailash Giri who is the

Learned counsel for the petitioner submits that petitioner was not present when the alleged recovery was made. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 16.01.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Runisaidpur P.S. Case No. 338 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C.
