JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 18-08-2015 Heard learned counsels for the petitioner, State and the informant.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 376 and 379 of the Indian Penal Code.

The prosecution case is that the petitioner established physical relationship with the informant on promise of marriage and subsequently fixed his marriage with another girl.

It is submitted by learned counsel for the petitioner that the informant has retracted from the initial version and filed a petition to that effect before the learned court below. The same has been brought on record as Annexure-4.

Patna High Court Cr.Misc. No.35024 of 2015 (2) dt.18-08-2015 2/2 Mr. Mithilesh Kumar Vidyarthi, learned counsel for the informant submits that the informant has performed marriage with the petitioner and the issue has been settled.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua Mahila P.S. Case No. 25 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
