JUSTICE SANDEEP KUMAR ORAL ORDER 24-03-2022 At the very outset, learned counsel for the petitioners submits that the present application has become infructuous as the petitioner No. 2 has been arrested and seeks permission to withdraw the same.

It is, thus, dismissed as withdrawn as having become infructuous against petitioner No. 2.

Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Khudaganj P.S. Case No. 57 of 2020 registered for the

Patna High Court CR. MISC. No. 28792 of 2021(3) dt.24-03-2022 2/2 offences punishable under Sections 341/323/324/326/379/307/ 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Considering the allegations, case and counter case between the parties and the nature of injuries, the present anticipatory bail application is allowed.

Accordingly, let the petitioner No. 1 (Sanju Yadav) above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Hilsa, Nalanda, in connection with Khudaganj P.S. Case No. 57 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
