JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.01.2022, charge-sheet has been submitted in the case and has antecedent of five cases. Allegation is of recovery of 215.49 litres of liquor from the house of the petitioner.

Learned counsel for the petitioner submits that the house from where the alleged recovery has been made is a joint family property and as such the petitioner was not knowing who had kept the liquor in the house.

Patna High Court CR. MISC. No.19605 of 2022(2) dt.22-04-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 10.01.2022 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Arwal P.S.
