This application is for grant of anticipatory bail in connection with Kishanganj Police Station Case No.617 of 2014for the offence under Sections 379 of the Indian Penal Code and further added Sections 419, 420, 467, 468, 471, 411, 413 and 414 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the name of the petitioner does not appear in the F.I.R., later on, on the basis of the confessional statement of the co-accused he has been named in this case and there is no recovery from the house of the petitioner rather the petitioner has clean antecedent. Heard learned A.P.P. also, who opposes the prayer for bail.

In view of the facts that the case is at the stage of investigation and also considering the fact that except the confessional statement of the co-accused, there is nothing against the petitioner, let the petitioner, above named, surrender before the court below within a period of six weeks, and the court below shall release him on provisional bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to his satisfaction in connection with Kishanganj Police Station Case No.617 of 2014, with a condition that once charge-sheet is submitted, he shall surrender before the court below and make prayer for regular bail, which will be considered by the learned court below on the materials available in the case diary at that time.
With the aforesaid observation, this application is disposed of.
