JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2019 This is an application for grant of anticipatory bail in connection with Sono P.S. Case No.230 of 2017, disclosing offences under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 41, 47 of the Bihar Excise Amendment Act. Allegation of recovery of 200 liters of illicit liquor from a Bolero and the petitioner happens to be the owner of the said vehicle.

Submission of the learned counsel for the petitioner is that he has no knowledge about the carrying of liquor and he has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, in view of the fact that petitioner happens to be the owner of the vehicle from which illicit liquor was recovered, I am not inclined to grant privilege

No.20984 of 2019(4) dt.25-06-2019 2/2 of anticipatory bail to the petitioner, however, the petitioner may move before the learned court below for regular bail which will be considered by the learned court below, without being prejudiced by order of this Court and if possible, be disposed of on the same day.
