JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 47(a)(c)(e)/53(b) of Bihar Excise Amendment Act, 2016.

Two liters country made liquor and 10 Kg. Mahua are said to have been recovered from the house of the petitioner. According to the Prosecution case itself, the petitioner was not present at the time of alleged recovery. Moreover, the petitioner is in jail custody since 3.6.2016 and does not have any criminal antecedent.

Accordingly, the petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand)

Patna High Court Cr.Misc. No.29519 of 2016 (2) dt.26-07-2016 2/2 with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Adhaura P.S. Case No. 26 of 2016.
