2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126(2), 191(2), 191(3), 109, 352, and 351(2) of BNS.

3. The case of the prosecution is that the petitioner along with others started assaulting one Lok Nath Singh. It is specifically alleged against this petitioner is that he has given tooth bite on the lips of the informant's brother.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the nature of

There is specific allegation against this petitioner is that he has given tooth bite to the informant's brother. Learned counsel has further submitted that from perusal of para-67 in the case diary, this petitioner has given his confessional statement wherein he has stated that he has assaulted the uncle of the informant who died. Learned counsel has submitted that there are two versions of the occurrence: In first version, the nature of allegation is general and omnibus whereas during course of investigation, the petitioner has given his confessional statement before police which has got no legal value in the eye of law. The version of the informant is that all the persons have assaulted the deceased. Moreover, the petitioner is languishing in judicial custody since 23.09.2025.

5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer of regular bail. They have further submitted that the petitioner himself has stated in his confessional statement that he himself has assaulted the deceased with iron rod.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named

Case No. 167 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Class, Judicial Magistrate, Bikramganj, Rohtas.
