JUSTICE SANJAY PRIYA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 498A, 354B and 506/34 of the Indian Penal Code.

It has been submitted that the petitioner is dewar of the complainant. He has falsely been implicated in this case. As per the written report, the informant was married to Prem Ranjan, brother of the petitioner. The allegation against the petitioner is that he tried to commit rape with her on 17.10.2016. The First Information Report has been lodged on 2.11.2016 after much delay.

Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six

Case No. 34 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bhagalpur, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
