JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 08-10-2018 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Bheldi P.S. Case No. 222 of 2018 registered under Sections 147, 148, 341, 323, 324, 379, 307, 504 and 506 of the Indian Penal Code.
It is submitted that there is a case and counter case and only one lacerated wound on forehead was found on the person of the informant. As far as the other two injuries on his person are concerned, they are simple and superficial, as the
Patna High Court Cr.Misc. No.57429 of 2018 (2) dt.08-10-2018 2/2 doctor has opined that there was swelling on right elbow and abrasion on his left finger.
Learned counsel for the State and learned counsel for the informant have opposed the prayer for grant of pre-arrest bail to the petitioners.
Considering the submissions made above as also the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner nos. 1, 2 and 4, namely, Satendra Manjhi, Jeetendra Manjhi and Ritesh Manjhi are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XII, Saran at Chapra in connection with Bheldi P.S. Case No. 222 of 2018 subject to the conditions as laid down under Section 438(2) Cr. P.C.
So far as the petitioner no.3, namely, Jeetesh Manjhi is concerned, I am not inclined to grant him pre-arrest bail, as he is the author of the injury, which was found on the forehead of the informant. His application is rejected. (Ashwani Kumar Singh, J.) Sanjeet/- U T
