1. Heard the parties.

2. This application, for grant of anticipatory bail, arises out of Sandesh P.S. Case No. 202 of 2023, dated 16.08.2023, registered under Sections 341, 323, 326, 307 and 504/34.

3. As per F.I.R. on 08.08.2023, at about 7:00 PM, the petitioner along with other accused person Shiv Parshan Yadav caught hold the informant and thereafter accused Rang Bahadur Yadav and Bir Bahadur Yadav assaulted the informant with knife due to which he sustained injuries.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in this case due to dispute regarding passage between both the parties. Both the parties are agnates having long standing dispute. The allegation of assault is not against the petitioner and only

5. Learned APP for the State submits that the injury sustained by the informant is found to be simple in nature.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are agnates having dispute regarding passage, injury sustained by the informant is simple in nature, I am inclined to grant privilege of anticipatory bail to the petitioner.

7. This application is, accordingly, allowed.

8. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Sandesh P.S. Case No. 202 of 2023, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
