The petitioner apprehends his arrest in Banmankhi P.S. Case No. 68 of 2016 instituted for the offence under Section 392 of the Indian Penal Code.
It has been submitted that the name of this petitioner has come merely on suspicion stating that looted mobile was used by the petitioner and also on the confessional statement of coaccused Kumod Kumar Yadav. The looted motorcycle has been recovered on 30.06.2016 on road by the police for which police registered a separate case against unknown persons. The written report has been filed against unknown.
From the written report itself it appears that the
Patna High Court Cr.Misc. No.4443 of 2017 (2) dt.14-02-2017 2/2 name of this petitioner has transpired on the confessional statement of co-accused Kumod Kumar Yadav. It is mentioned in para-3 of bail petition that petitioner has no criminal antecedent. In the circumstances, prayer of the petitioner for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Banmankhi P.S. Case No. 68 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, subject to the conditions as laid down under Section 438(2) Cr.P.C.
