The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273, 414/34 of the Indian Penal Code and under Sections 37(a), 38, 41/48 of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 59 litres 250 Ml of foreign liquor was recovered from a Tempo which was being boarded by two persons. It is urged that the petitioner is the owner and driver of the said Tempo. It is further alleged that the seized liquor belongs to co-accused Mintu Kumar who was being boarded in the aforesaid Tempo. It is also contended that nothing has been recovered from the conscious possession of the petitioner and he has been falsely implicated in the present
Patna High Court Cr.Misc. No.58433 of 2018(2) dt.06-10-2018 2/2 case. Petitioner claims that he is having clean antecedent and is in custody since 08.08.2018.
Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Muzaffarpur, in connection with Minapur P.S. Case No. 80 of 2018. If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
