JUSTICE RAKESH KUMAR ORAL ORDER 21-10-2016 Heard Sri Bachan Jee Ojha, learned counsel for the petitioner and Smt. Gulnar Begam, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 21.03.2016 in Nabinagar P.S. Case No.35/2016 registered for the offence under Sections 25(1-B)a/26 of the Arms Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that though the petitioner was arrested in the month of March, 2016, till date no adequate progress has taken place in the case before the court below.

Learned Addl. Public Prosecutor, opposing the prayer for bail of the petitioner, submits that the petitioner is

Patna High Court Cr.Misc. No.31995 of 2016 (3) dt.21-10-2016 2/2 having criminal antecedent.

However, keeping in view the fact that the petitioner was arrested in the month of March,2016, but till date no adequate progress has taken place, let the petitioner, namely, Jawahir Ram be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S. Case No.35/2016 with conditions that (i) one of the bailors must be blood relation of the petitioner and (ii) during trial, on each and every date, the petitioner shall remain physically present before the court below. If continuously on two dates, the petitioner remains absent without prior permission of the trial court, his bail bond shall stand automatically cancelled.
