The petitioner is apprehending his arrest in connection with Complaint Case No. 196 of 2015 lodged for the offences punishable under Sections 448, 323 and 380 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that a partition suit is going on between the parties and the allegation is that accused persons, including the petitioner have entered into the house of the complainant and taken away Rs.50,000/- and other articles.

Having heard both sides and considering the

Patna High Court Cr.Misc. No.6196 of 2017 (2) dt.16-02-2017 2/2 allegations made in the complaint petition, let the petitioner, above named, in the event of his arrest/surrender in the court below within a period of two weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad (Bihar), in connection with Complaint Case No. 196 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to further conditions that petitioner shall co-operate in the investigation and make himself available before police, as and when required, and in the event of failure on his part to appear before the police, prosecution shall be at liberty to move for cancellation of bail bond.
