JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 396 of the Indian Penal Code and Section 3⁄4 of Explosive Substance Act.

It is a serious case of dacoity with murder but petitioner is not named in the first information report and during course of investigation, the name of petitioner surfaced in this case. It would appear from perusal of the case diary that in course of investigation, witnesses claimed to have learnt the name of the petitioner after the alleged occurrence and except the aforesaid material, there appears to be nothing against the petitioner, who is languishing in jail custody since 24.06.2016 without having any

Patna High Court Cr.Misc. No.37026 of 2016 (3) dt.10-11-2016 2/2 criminal antecedent. Moreover, some co-accused have already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Sitamarhi in connection with Nanpur P.S. Case No. 06 of 2014.
