JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 02-05-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Complaint Case No. 108 of 2015 for the offences punishable under sections 341, 323, 379 and 504/34 of the I.P.C.

Allegedly, the petitioners surrounded the complainant and on protest accused-petitioner Dinanath Singh instigated to assault and then all assaulted with fists and slaps and in the meantime accused-petitioner Jainendra Singh took out Rs. 5,000/- from the pocket of the informant and accused-petitioner Kiran

Patna High Court Cr.Misc. No.3736 of 2017 (6) dt.02-05-2017 2/2 Devi took Titen wrist watch valued at Rs. 1500/- and further accused-petitioner Dinanath Singh took away cycle of the informant valuing Rs.3500/-.

Submission is of false implication and that this case is counter blast of Jamhor P.S. Case No. 07 of 2015, nothing has been taken away from the complainant, all the allegations are false and concocted, this case has been lodged after eleven days delay by making false allegation, all the witnesses are relatives and the family members of the complainant.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioners.

In the facts and circumstances as stated above, considering that this case is counter blast of Jamhor P.S. Case No. 07 of 2015 and as such the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of.
