The petitioner is languishing in custody since 01.02.2019 in a case registered for the offences punishable under Sections 363, 366A, 302 and 201/34 of the Indian Penal Code.

The prosecution case, as per the written report of Salma Begum submitted to the Station House Officer of Rajpur Police Station, is to the effect that 17 years old daughter of the informant, Asma Khatoon was enticed away by co-accused Chhotu Ansari on 30.12.2018 for the purpose of marriage. When the informant inquired about it from the uncle of Chhotu Ansari namely, Nishar Ansari, he conveyed that they are also for searching him. It is alleged against the petitioner and five others

Patna High Court CR. MISC. No.20899 of 2019(2) dt.04-04-2019 2/2 co-accused persons that they facilitated the enticing away the daughter of the informant by co-accused Chhotu Ansari and subsequently, the dead body of the informant was recovered. It is submitted by learned counsel for the petitioner that the thrust of accusation is against co-accused Chhotu Ansari and there is no eye witness to the alleged occurrence. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the name of the petitioner sprang up during investigation who facilitated co-accused Chhotu Ansari to entice away the daughter of the informant.

Considering the thrust of accusation against coaccused Chhotu Ansari and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 7, Buxar in connection with Rajpur P.S. Case No. 06 of 2019.
