Petitioners seek bail in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2018.

Liquor was recovered from a vehicle on which three person including the petitioners were travelling. Petitioners have got no criminal antecedent. They are in custody since 10.02.2020. Investigation of the case is already complete. Considering the entire facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand)each with two sureties

No.17268 of 2020(2) dt.13-05-2020 2/2 of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Case No.12 of 2020, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.

If the petitioners would not be able to furnish sureties due to lock-down, they shall be provisionally released on their personal bond and the provisional bail shall be confirmed only after production of the bailors within fifteen days of restoration of normal function of the Court.
