Earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 22.01.2016 passed in Cr. Misc. No. 44601 of 2015 taking note of the materials came against the petitioner in course of investigation.

Submission on behalf of the petitioner is that coaccused Awadhesh Kumar, who was Assistant Manager of the Bank at the relevant time, has already been admitted to anticipatory bail by a co-ordinate Bench of this Court vide order dated 25.04.2016 passed in Cr. Misc. No. 2768 of 2016. It is further submitted that charge against the petitioner has already

Patna High Court Cr.Misc. No.34952 of 2016 (2) dt.21-09-2016 2/2 been framed on 29.07.2016 and according to the prosecution case itself, it was co-accused Suman Kumar, who opened the account and withdrew the amount in question.

Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner is in jail custody since 09.06.2015 and having more or less similar allegation, one co-accused has already been admitted to anticipatory bail by a coordinate Bench of this court, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Madhubani Town P.S.Case No. 225 of 2015.
