The petitioner apprehends his arrest in Tandwa P.S. Case No. 13 of 2014 registered under section 304(B)/34 of the Indian Penal Code.

The brother of the deceased made allegation that his sister Shakuntla Devi was married to Sanjay Sao in the year 2010 and thereafter her husband and in-laws were demanding rupees one lakh. On 18.05.2014 the informant got information on telephone that his sister was done to death by strangulating and burning.

It is submitted that petitioner is the husband but during the course of investigation it has come that none of the families were present in the house. Shakuntla herself committed

Patna High Court Cr.Misc. No.42230 of 2014 (3) dt.02-04-2015 2/2 suicide. It appears from perusal of the record that the informant had made very specific allegation that the petitioner being the husband was subjecting his wife to torture and wife of the petitioner was done to death within five years of marriage, hence I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
