JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 149, 307 and 323 of the Indian Penal Code and, subsequently, Section 302 of the Indian Penal Code has been added.

Prosecution case is that while informant was sleeping at his door, the accused persons came there and abused him. On protest, informant was assaulted. When informant's father came to pacify the matter, he was also assaulted on his head. Informant's father died in course of treatment. It has been submitted on behalf of the petitioner that he is in custody since 26.5.2016. Chargesheet has been submitted against the petitioner. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner. The main allegation is against one Sitaram Bind, who is alleged to have assaulted upon the deceased causing his death. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Mohania P.S. Case no. 215 of 2016.
