Petitioner prays for bail in connection with Jehanabad Mahila P.S.Case No. 27 of 2018, corresponding to Sessions Trial No. 280 of 2018, registered for the offences punishable under Sections 376/34 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is of committing rape upon the victim girl. Submission of learned counsel for the petitioner is that the girl has been examined in court and she has not identified the accused persons and also not named this petitioner. Further submission is that petitioner is in custody since 11.6.2018. Heard learned APP also.
Having heard both sides and in view of allegation, I am
Patna High Court Cr.Misc. No.57848 of 2018 (2) dt.28-09-2018 2/2 not inclined to grant bail to the petitioner. However, since trial has commenced, learned trial court is directed to expedite the trial and try to conclude it within a period of six months. If trial is not concluded within the said period, learned trial court shall release the petitioner on bail to its own satisfaction.
With the above observation, this application is disposed of.
