In this case, the petitioner is seeking regular bail in connection with Gopalpur P.S. Case No. 345 of 2019 registered for offence punishable under section 302/34 of the Indian Penal Code and section 27 of the Arms Act.

Allegation has been made that when the victim had objected for grazing of the standing crops, four accused persons, including the petitioner came there and resorted firing. At the behest of Siyaram Yadav, Puja Yadav, Lalo Yadav and Siyaram Yadav all the three caught hold the victim and started assaulting and put his nose/head under the water and on that account he died.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No. 19961 of 2020(4) dt.03-03-2021 2/2 general and omnibus allegation has been made against this petitioner, but from the record it appears that three persons put the nose/head of the victim under the water and on that account he died.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected.

The court below is directed to conclude the trial within a period of nine months from the date of receipt/production of a copy of this order.
