JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 392, 411, 120B of the Indian Penal Code.
Petitioner is in jail custody since 21.01.2015 as mentioned in impugned order though the learned In-charge court has reported that petitioner was remanded in the present case on 20.02.2015.
Earlier the prayer for bail of the petitioner was rejected by this court taking note of allegation as well as his antecedent but the report of In-charge court goes to show that there is no possibility of conclusion of trial of the petitioner in
Patna High Court Cr.Misc. No.34345 of 2016 (4) dt.18-01-2017 2/2 near future as the case of the petitioner is still pending for appearance of other accused.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri B.K. Tripathy, Judicial Magistrate 1st Class, Vaishali in connection with Mahua P.S. Case No. 514 of 2014.
