JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 341, 323, 307, 379, 337, 504/34 of the Indian Penal Code.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that there is general and omnibus allegation against all the accused persons including the petitioner. There is one injury which is said to be grievous in nature and for that a Medical Board was constituted but informant had not appeared before the Board. One similarly situated co-accused has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 22.12.2016 passed in Cr. Misc. no. 54909 of 2016.

Having heard both sides, in view of the fact stated above that there is general and omnibus allegation against the petitioner, let above named petitioner, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Nawada, in connection with Akbarpur P.S. Case no. 141 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. There are other conditions also that bailors should be local having property within the jurisdiction of the court concerned and petitioner shall cooperate in the investigation and make himself available before the police as and when required.
