JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-07-2019 The petitioner apprehends his arrest in connection with Beldour P. S. Case No. 132 of 2014 registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner in the FIR is that one Dilip Panjiyar and this petitioner allegedly fired upon the grand father of the informant, who subsequently died. Mr. Ramakant Sharma, learned senior counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case and the police, after thorough investigation, has submitted final form not sending the petitioner and others, named in the FIR, for trial and charge sheet has been submitted against non-FIR accused persons. After having heard learned counsel for the parties and taking into consideration the fact that police has submitted final form against the petitioner, accordingly, I am inclined to grant anticipatory bail to the petitioners.

Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Beldour P.S.Case No. 132 of 2014; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
