The petitioner apprehends his arrest in connection with Murliganj P.S. Case No.180/13 registered under Sections 419, 420, 467, 468, 471, 472, 409 and 120(B) of the Indian Penal Code. The accusation is of enrolment of the students on the basis of forged transfer certificate and also filling up OMR form for taking the benefit of cycles, dress and scholarship of the
Patna High Court Cr.Misc. No.5087 of 2017 (2) dt.18-03-2017 2/3 students at B.L.High School, Murliganj. Government High School, Amari,Circle- Murliganj, A.P.C. High School, Murliganj, B.L.High School, Murliganj, Bhuwaneshwary High School, Murliganj, Rajnandan Prasad High School Pratapnagar, Murliganj in collusion with the Secretary, clerk and Headmaster of the said school and misappropriation of fund allotted for that purpose. Learned counsel for the petitioner submits that it would appear from the F.I.R. that in column 3 of the written report Rajendra Kumar, Head Master of B.L.High school, has been made accused. While the petitioner was Headmaster at B.L. High School but he retired from that post on 5.12.2012.
Further submission is that Rajendra Kumar@ Rajendra Yadav has already been allowed bail by a coordinate Bench of this Court vide order dated 05.01. 2016 passed in Cr.Misc. No.17567/15. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.5087 of 2017 (2) dt.18-03-2017 3/3 sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura, in connection with Murliganj P.S. Case No.180/13, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
