JUSTICE SANDEEP KUMAR ORAL ORDER 10-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Special Excise Case No. 56/2023 (Arising out of Shahpur P.S. Case No. 8/2023), registered for the offence punishable 30(a)/41 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent. Nothing incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 09.01.2023.

Learned APP has vehemently opposed the prayer for bail.

Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the court of Special Excise Judge, Danapur, in connection with Special Excise Case No. 56/2023 (Arising out of Shahpur P.S. Case No. 8/2023).
