It appears from perusal of the record that the petitioner had moved before this Court and it was disposed of vide order dated 17.10.2017 passed in Cr. Misc. No45527 of 2017 with condition that the learned court below shall verify the criminal antecedent of the petitioner and it is found that he is accused in only three cases viz. i. Koilwar P.S.Case No.163 of 2015, ii. Ara Nawada Town P.S.Case No.248 of 2015 and iii. Ara Nawada Town P.S.Case No.153 of 2014 and also after verifying the fact that save and except allegation as mentioned, nothing has been brought against the petitioner, he shall release the petitioner on bail and it appears that he has been granted bail by the learned court below and the informant has moved for cancellation of his bail bond and vide order dated 16.5.2018 passed in Cr. Misc.

Patna High Court Cr.Misc. No.58039 of 2018 (2) dt.19-09-2018 2/2 No.3765 of 2018 his bail bond was cancelled and in pursuance of that he has surrendered on 31.7.2018 and since then he is in custody and there is no specific allegation against the petitioner and at best he is conspirator.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara in connection with Ara Town P.S.Case NO.366 of 2017 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
