JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-01-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor representing the State. This criminal revision application has been filed against an order, dated 01.06.2016, passed in Criminal Appeal (Juvenile) No. 38 of 2016, whereby learned Sessions Judge, Gaya, has rejected the appeal preferred against an order, dated 25.04.2016, passed by the Juvenile Justice Board, Gaya, in Gaya Rail Police Station Case No. 98 of 2015.

The petitioner is a juvenile and he is an accused in a case disclosing offence punishable under Sections 302/201/120A/379/34 of the Indian Penal Code and Section 3 (ii) (v) of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act.

No.641 of 2016 (4) dt.30-01-2017 2/2 By an order, dated 09.01.2017, the Juvenile Justice Board, Gaya, was directed to send a report as regards the present status of enquiry under Section 14 Juvenile Justice (Care and Protection of Children) Act, 2000. In pursuance to the said order, dated 09.01.2017, a report has accordingly been submitted by learned Principal Judicial Magistrate, Juvenile Justice Board, Gaya.

On perusal of the said report, it appears that the petitioner has absconded from the Observation Home and the enquiry, under Section 14 Juvenile Justice (Care and Protection of Children) Act, 2000, is pending for appearance of the petitioner.
