The petitioner apprehends her arrest in connection with Piprahi P.S. case No. 7 of 2016 instituted under Sections 409, 420 and 188 of the Indian Penal Code.

The allegation, in brief, is that Rs. 8,67,456/- was taken as advance for the construction of the School by the headmaster and only construction was done worth Rs. 3,46,954/-. It is submitted that the petitioner is Secretary of Lok Shiksha Samiti moreover she was not even named in the FIR but later on her name was added. The D.P.O. on whose instruction the FIR was lodged has already submitted a report that now the work has been completed except installation of doors and windows. Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.5548 of 2017 (2) dt.07-02-2017 the case, let the petitioner, namely, Sita Devi in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Piprahi P.S. case No. 7 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
