The petitioner apprehends his arrest in Complaint case No. 575 of 2015 for the offence allegedly committed by the petitioner under Section 498(A) of the Indian Penal Code. The wife of the petitioner made allegation of demand of dowry and torture. She also alleged that petitioner has solemnized second marriage but learned counsel for the petitioner submits that petitioner has not solemnized second marriage. The petitioner is ready to keep his wife on any undertaking. Considering the willingness of the petitioner to keep his wife, the above named petitioner is directed to surrender in the court below within four weeks from today and the court below shall grant provisional bail to the petitioner for four months on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with
Patna High Court Cr.Misc. No.1323 of 2017 (2) dt.16-01-2017 2/2 two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Jehanabad, in Complaint Case No. 575 of 2015.
The court below shall make all efforts for resolving the dispute between the husband and the wife. If the petitioner keeps his wife properly, the provisional bail granted to the petitioner shall be confirmed. In case the petitioner is not willing to keep his wife, the court below shall pass orders on the prayer for provisional bail of the petitioner, immediately after lapse of four months, on its own merit in accordance with law.
