Petitioner is in custody in connection with S.T. No. 786 of 2018 arising out of Rupaspur P.S. Case No. 414 of 2018 for the offence under sections 399, 402, 379, 411 and 414 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act. Learned counsel for the petitioner would submit that in the instant case recovery of loaded country made pistol and 315 bore one cartridge was made from Viccky Kumar and not from the possession of the petitioner.
The said Viccky Kumar was granted bail by a coordinate Bench of this court.
The petitioner is in custody since 27.5.2018. Considering the fact that petitioner has remained in
Patna High Court CR. MISC. No.19675 of 2019(2) dt.01-04-2019 2/2 custody for more than 10 months and also the fact that coaccused Viccky Kumar from whose possession loaded country made pistol was recovered has been granted bail, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II, Danapur, in connection with S.T. No. 786 of 2018 arising out of Rupaspur P.S. Case No. 414 of 2018.
