2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 307, 504 and 34 of the Indian Penal Code and section 27 Arms Act.
3. As per the prosecution case, on the alleged date and time of occurrence when the informant was grazing his cattle , meanwhile this petitioner along with other co-accused persons came there and started abusing him, meanwhile , co-accused Dayalu Yadav fired upon him.
4. It is submitted on behalf of the petitioner that specific accusation of causing fire upon the informant is against co-accused Dayalu Yadav. So far as this petitioner is concerned there is no allegation of assault against him and he is only

5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Banka in connection with Rajoun P.S. case No. 510 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
