JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 302/34 of the I.P.C. and Sections 3, 4, 5 of the Explosive Substance Act.
The prosecution story, in brief, is that on the alleged date and time of occurrence Mukhiya candidate Kaushalya Devi wife of Arjun Yadav along with 40-50 motorcycles and six four wheelers proceeded to Chakai for nomination and they reached at Block office and after nomination they were exit to Kishan Bhawan, all of sudden 4-5 unknown miscreants came and threw bomb upon Arjun Yadav and thereafter he fell down and became badly injured. In the meantime again two bombs blasted on Arjun Yadav. Arjun Yadav had been sent to Deoghar Hospital for
Patna High Court Cr.Misc. No.31848 of 2016 (3) dt.23-09-2016 2/2 treatment but in the way he died.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.3.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The main allegation is against Karu and Tetua. As far as the petitioner is concerned, his involvement has been suspected on the basis of C.D.R. report.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd A.C.J.M., Jamui in connection with Chakai P.S. case No.20 of 2016 (G.R. No.352 of 2016).
