Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within two weeks of the complete start of the physical Court in normal course.

The petitioner seeks regular bail in connection with Madanpur P.S. Case No. 144 of 2020 for the offence punishable under Sections 341, 323, 504, 506, 307 and 302/34 of the Indian Penal Code.

Allegation against the petitioner is that by means of Jhaam he assaulted the deceased (Ram Pravesh Yadav) due to which he sustained head injury and succumbed to the injury.

Patna High Court CR. MISC. No.29777 of 2021(5) dt.25-03-2022 2/2 The injury is supported by the post mortem report and the doctor has opined the cause of death due to hard and blunt substance on the head of the deceased.

Considering the serious allegation made against the petitioner of having committed murder of one Ram Pravesh Yadav, I am not inclined to enlarge the petitioner on bail at this stage.

Accordingly, the present bail application is rejected. The trial court is directed to conclude the trial expeditiously well within a period of nine months. If no substantial progress takes place in the trial within the aforesaid period, the petitioner, if so advised, may renew his prayer for bail.
