JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-07-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No.2065 C of 2016, disclosing offence under Section 498A of the Indian Penal Code. Allegation against the petitioner is of demand of Rs.2,00,000/- and for that, assaulting and ousting her from the house and also tried to set her on fire.

Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted. He is still ready to keep her with dignity and care.

On the other hand, learned counsel for the opposite party no.2 has submitted that she is not ready to live with the petitioner, rather she is interested for one time settlement

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of two weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub- Divisional Judicial Magistrate, Araria, in connection with Complaint Case No.2065 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that if the opposite party no.2 is still ready to reside with him, he is to keep her with dignity and care.
