Petitioner is in custody since 13.10.2013 in connection with Patna Rail P.S. Case No. 230 of 2013 registered under Sections 364, 302/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R. merely on the basis of confessional statement of co-accused, Priyanka Kumari and Pratibha Devi, the name of this petitioner has surfaced in this case. Nothing incriminating articles have been recovered from the possession of this petitioner nor has the petitioner been put on T.I.P. The petitioner is rotting in custody for the last three months.

Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.36840 of 2016 (5) dt.06-03-2017 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge,- VIII, Patna in connection with Str. No. 95 of 2014 arising out of Patna Rail P.S. Case No. 230 of 2013.
