The petitioners are languishing in custody since 19.05.2016 in connection with Azam Nagar (Salmari) P.S. Case No. 148 of 2016 for the offences instituted under Sections 392 and 411 of the Indian Penal Code.
The prosecution story, in brief, is that one live cartridge was recovered from the possession of the petitioner no. 1 and on being asked both the petitioners failed to produce any relevant document regarding possession of such arms. It has been submitted on behalf of the petitioners that the petitioners are in custody since 19.05.2016 and the charge sheet has been submitted in the present case. There is
Patna High Court Cr.Misc. No.35509 of 2016 (3) dt.24-10-2016 2/2 no allegation of tampering of the witnesses alleged against the petitioners. Petitioners are named in the F.I.R. One live cartridge is said to have been recovered from the possession of the petitioner no. 1. For the same offence a case was instituted under the Arms Act and in that the petitioners have been allowed bail by the court below. It is further submitted that the petitioners may be released after completion of six months from 19.05.2016. On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail, after completion of six months from 19.05.2016, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Katihar in connection with Azam Nagar (Salmari) P.S.
