JUSTICE SUDHIR SINGH ORAL ORDER 20-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 325, 307 and 302 of the I.P.C. and Section 27 of the Arms Act. The prosecution case, in brief, is that on the alleged date and time of occurrence the informant's husband Surendra Sahni came to his home from Sasural and at the same time the accused persons including the petitioners came to her house and started beating her husband and dragged him towards the field and then they brutally assaulted her husband by fists, lathi and danda and they shot firing on the leg of the deceased and when her mother-in-law tried to save her husband, she was also assaulted by

It has been submitted on behalf of the petitioners that the petitioner Nos.1 and 3 are in custody since 8.4.2015 and petitioner No.2 is in custody since 17.3.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioners. General and omnibus allegation has been made against the petitioners. No specific injury has been attributed against the petitioners. The other co-accused have been granted bail vide Cr.Misc.No.17784 of 2016 and Cr.Misc.No.33740 of 2016.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Darbhanga in connection with Sessions Trial No.316 of 2015 arising out of Bahadurpur P.S. case No.69 of 2015.
