The petitioner has been in custody since 01.07.2018 in connection with Behiya P.S. Case No. 42/2016 registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that though he is not named in the First Information Report, subsequently, after a lapse of 2 1⁄2 years, the name of the petitioner has figured in connection with the present case. It is further submitted that the said name has surfaced only after a lapse of 2 1⁄2 years and till date, he has not been put on T.I. Parade and no recovery has been made from him.
