This application, for grant of anticipatory bail, arises out of Rosera Police Station Case No. 156 of 2018, disclosing offences under Sections 379, 461 and 411 of the Indian Penal Code.

One Santosh Kumar Sah was apprehended by the Police in course of investigation, who had disclosed the names of his accomplice Ashok Chaurasiya, from whose possession, certain stolen articles were recovered. The petitioner's name has transpired in course of investigation on the basis of confessional statement of co-accused Santosh Kumar Sah. Over and above the said confessional statement, there is no material against this

Patna High Court CR. MISC. No.17653 of 2019(2) dt.26-03-2019 2/2 petitioner, learned Counsel submits. The petitioner has no criminal antecedent.

Considering the above, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate I, Rosera, Samastipur, in connection with Rosera Police Station Case No. 156 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
