JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code read with Sections 30(a), 38, 41 and 48 of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 19.01.2022, charge-sheet has been submitted in the case and has antecedent of three cases. Allegation is of recovery of 772.56 litres of liquor kept hidden in a straw at the place of occurrence. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and he was identified by the local chowkidar with whom he was on an inimical term.

Considering the fact that the petitioner is in custody since 19.01.2022, charge-sheet has been submitted in the case and he was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Minapur P.S. Case No. 1 of 2019.
