The instant petition has been filed for challenging the order dated 16.10.2019 passed in Matrimonial Case No. 200 of 2018 by the learned Principal Judge, Family Court, Patna whereby and whereunder the learned Family Court has awarded maintenance of Rs. 8000/- per month to the respondent and also seeking direction to the learned Family Court to decide the matrimonial case within specified time.

3. Learned counsel for the petitioner submits that initially the petitioner has filed Matrimonial Case No. 1108 of 2015 which got dismissed in default and, thereafter, another suit was filed. Earlier the matter was settled between the petitioner and the respondent and respondent took Rs. 5,00,000/- towards settlement of permanent alimony of Rs. 15,00,000/- but

No.455 of 2020(8) dt.01-02-2024 2/2 subsequently she resiled and withdrew her consent even for dissolution of marriage by mutual consent and the learned Family Court ordered the respondent to return the amount of Rs. 5,00,000/-. Learned counsel further submits that he is confining his prayer only to the extent that the learned Principal Judge, Family Court, Patna may be directed to dispose of the Matrimonial Case No. 200 of 2018 within a specified time.

4. Since the matrimonial case is pending in the learned trial court from the year 2018, the learned Principal Judge, Family Court, Patna ought to have taken pains and dispose of the matter expeditiously considering the issues involved.

5. In view of only prayer for early disposal of the case before the learned Principal Judge, Family Court, Patna, without going into merits, the present petition stands disposed of with direction to the learned Principal Judge, Family Court, Patna to decide the Matrimonial Case No. 200 of 2018 within six months from the date of receipt/production of a copy of this order.
