Petitioners are apprehending their arrest in a case registered for the offences punishable under Section 33 of the Forest Act.
Accusation against the petitioners is of litting fire in the forest area, as a result, several plants were damaged. It is submitted by the learned counsel for the petitioners that the case was lodged in 2010 and accusation is omnibus and general against several accused persons. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Patna High Court Cr.Misc. No.36559 of 2015 (2) dt.10-09-2015 The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with F.O. Case No. 42 of 2010, pending in the court of learned Chief Judicial Magistrate, Nawada.
With this observation this application is disposed of.
