ANJANA MISHRA ORAL ORDER 22-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Complaint Case No. 1494 C of 2013 registered for the offences punishable under Section 498-A/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the husband is willing and ready to keep the lady in question with full dignity and honour and will not raise any demand of dowry and he also undertakes that there shall be no recurrence of any untoward act which would amount to mental torture.
Considering the aforementioned submissions and bonafide offer made by the petitioner, let the petitioner, in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be
Patna High Court Cr.Misc. No.43696 of 2014 (2) dt.22-04-2015 P2/2 enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Complaint Case No. 1494C of 2013 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. It is however, made clear that if there is recurrence of any act of torture, it will be open to the opposite party to approach this Court for appropriate orders.
